Court & LawKeep the client informed

Weeks pass in a case and the client hears nothing. You keep the client reasonably informed about the status, answer reasonable requests promptly, pass on every communication that may significantly affect settlement, act without delay and make clear when the work ends. It follows Rules 1.4 and 1.3 of the Virginia Rules of Professional Conduct.

Scenarios

  • The client calls asking what is happening with the case.
  • Opposing counsel sends a settlement offer.
  • The case ends with a result adverse to the client.

The steps

  1. Keep the client reasonably informed about the status of the matter.
  2. Comply promptly with the client's reasonable requests for information.
  3. Inform the client of the facts pertinent to the matter.
  4. Inform the client of communications from another party that may significantly affect settlement or resolution.
  5. When opposing counsel offers a settlement or a plea agreement, promptly tell the client its substance, unless prior discussions made clear the proposal will be unacceptable.
  6. Keep the client advised of the status even when the client delegates authority to you.
  7. When many routine matters are involved, arrange a system of limited or occasional reporting with the client.
  8. Act with reasonable diligence and promptness: delay can harm the client's interests and cause needless anxiety.
  9. If a proceeding ends with an adverse result and you have no instructions on an appeal, advise the client of the possibility of appeal before you relinquish the matter.
  10. When it is unclear whether the relationship still exists, clarify it, preferably in writing, so the client does not assume you are still looking after the matter.

Safety rules that stop the station

  • Never withhold information to serve your own interest or convenience.

To pass

  • The client knows the status of the matter and gets prompt answers.
  • Every communication that may affect settlement reaches the client.
  • The matter moves without delay and the end of the relationship is clear.
